Sen. Amy Klobuchar Calls Texas Affordable Care Act Ruling ‘Absurd’

President Donald Trump, in reacting to Judge O'Connor's ruling, suggested that it was time for Congress to get to work on a new law.

But it is so sweeping that many legal analysts believe it is likely to be overturned. The decision has "no impact to current coverage or coverage in a 2019 plan", Seema Verma, administrator for the Centers for Medicare and Medicaid Services, wrote on Twitter.

Nearly exactly one year after passing the tax-reform package that eliminated the individual mandate in ObamaCare, Republicans got the ruling they wanted on Friday. The original mandate was upheld in previous court rulings as a tax. O'Connor was appointed to the federal bench by President George W. Bush.

While the court's "absurd ruling will be immediately appealed, Republicans are fully responsible for this cruel decision", she said.

Senator Chuck Schumer, the top Democrat in the Senate, castigated Republicans for "pretending to support people with pre-existing conditions while quietly trying to remove that support in the courts".

No. 2 House GOP leader says a shutdown would be 'stupid'
Several aides said they believed restlessness by younger members to move up in leadership would make that hard for her to achieve. She would be the first speaker to do so since Texas Democrat Sam Rayburn took the gavel back in 1955.

President Trump is ready to go with the new Congress in January.

Democrats weren't the only ones to criticize the decision.

Healthcare advocates, though admitting that the ruling will likely be repealed, quickly addressed the concern that the attack on the ACA could harm133 million Americanswho rely on the law's rule banning insurance companies from refusing coverage based on pre-existing conditions, and the 20 million Americans who gained insurance because of the law.

"As our nation is in the midst of an opioid crisis, this coverage is especially needed", Evans said in a statement.

Other experts have pointed out what they said was a more fundamental problem with O'Connor's ruling: the states did not have the standing to sue in the first place. The plaintiffs argued that because the Supreme Court upheld the ACA in 2012 as a constitutional use of its taxing power, the elimination of the tax makes the rest of the law unconstitutional.

A multinational effort to find survivors included U.S., Japanese and Australian aircraft and U.S. and Japanese ships. Two pilots of the F/A-18 fighter jet were rescued after the accident, but one of them later died.

The Texas judge agreed. The ACA also mandates coverage of certain "essential" insurance benefits, including maternity care. The Texas Attorney General, joined by a consortium of 18 other state attorneys general and a governor, initiated a lawsuit attacking the ACA soon thereafter, arguing that the elimination of the linchpin penalty provision rendered the entire law unconstitutional. They say that the tax bill specifically elected to preserve the ACA's consumer protections despite eliminating the individual mandate penalty. "Now we have a judge saying we have an unenforceable mandate".

Without federal subsidies, most customers could no longer afford "Obamacare" insurance. As of December 8, 4.1 million people had chosen plans through the federal-government run portal that 39 states use for enrollment. In the prior year, the total enrolled was 12.2 million. "The latter sawed off the last leg it stood on".

California and Democratic officials in 14 states, along with the District of Columbia, won permission to defend the ACA in the Fort Worth case when the Trump administration sided with the states seeking to dismantle it. This decision denies coverage to more than 100 million Americans, including seniors, veterans, children, people with disabilities, hardworking Americans with low-incomes, young adults on their parents' plans until age 26, and millions of Americans with pre-existing conditions.

Dr. Ezekial Emanuel, who also developed Obamacare, is calling the ruling "silly" and is confident it will be upheld for a second time at the Supreme Court. Those include parts of the law on adding calorie counts on restaurant menus and speeding to market cheaper versions of costly biotechnology drugs.

Obama signed the Affordable Care Act in 2010, and most of the provisions took effect in 2014. Claire McCaskill. Another plaintiff, West Virginia Attorney General Patrick Morrisey, lost to Democratic incumbent Sen.
