Apple to update iPhone software after threat of China ban
Dec 15, 2018, 00:56
After bringing suit against Apple past year in an effort to ban iPhone sales in the U.S., Qualcomm came under fire from companies such as Intel for anti-competitive behavior.
In a statement to the wire service, the iPhone maker said, "early next week we will deliver a software update for iPhone users in China addressing the minor functionality of the two patents at issue in the case". Apple is claiming that iOS 12 does not infringe on either of the two patents at the core of the latest dispute with Qualcomm. The media claim the ruling will block the sales of a number of iPhone models (from iPhone 6S all the way up to iPhone X).
Unsurprisingly Qualcomm disagreed. "Apple continues to disregard and violate the Fuzhou court's orders", Don Rosenberg, general counsel at the chip-maker, argued, suggesting that it wasn't down to Apple to decide what did and did not meet the terms of the court order.
But Apple isn't ready to capitulate to Qualcomm's demands.
In spite of the court injunctions, Apple has not pulled the affected iPhone models from its official online and offline sales platforms in China. Apple representative was quoted to say that the company will be forced to settle with the Respondent, causing all mobile phone manufacturers to relapse into the previous unreasonable charging mode and pay high licensing fees.. But it was not clear whether this referred to the latest case or their broader legal dispute.
Michigan House votes to extend legislative power
He may also be able to line-item veto portions of them, depending on how they are drafted and whether they spend money. But before they are sworn, GOP legislators are hoping to enact laws limiting or affecting the Democrats' powers.
Apple did not immediately respond to questions about the reconsideration request and Reuters was not independently able to confirm its authenticity. However, intellectual property lawyers said enforcement of the ban was likely still a distant threat.
Since the ban went into effect, Apple has argued that it does not apply to any of the iPhones it now sells due to the fact they run iOS 12, not iOS 11. "That's always the game".
